This means that the injured person and the liable party and his or her insurer actually come to an agreement without having to have a judge or jury involved.

3. Not all injured parties “win.”
In these cases, you might think that the injured party usually wins, but this isn’t true. In the few cases that do go to court, only about 50% of plaintiffs (that’s the injured party) actually win. Additionally, liability in these cases doesn’t always fall on one person, so damages are not always 100% of what the plaintiff sues for.
